1. GENERAL PRIVACY DISCLOSURE

Hornig Law, LLC, does not collect personally identifying information from visitors to this web site (e.g., name, address, telephone number or e-mail address) unless such information is provided by the visitor or by the visitor’s browser. Information provided through a visitor’s use of this site will only be used to respond to direct inquiries, subscription requests, or to measure traffic and traffic trends at the website. We will not be liable for disclosures of your personal information due to errors in transmission or unauthorized acts of third parties. However, once we receive your transmission, we do our best to ensure its security on our systems by making reasonable efforts to protect the information. In the course of providing our clients with requested legal services, we often receive non-public personal financial and other information from our clients or from third parties at the request of our clients. Hornig Law, LLC, does not disclose any non-public personal information outside the firm, except as agreed to or requested by our clients or required by law, and otherwise described below in greater detail. In order to maintain our clients’ non-public personal information, we maintain physical, electronic, and procedural safeguards that comply with our professional service standards as well as federal regulations.


2. WHAT INFORMATION DO WE COLLECT?

We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when expressing an interest in obtaining information about us or our products and services, when participating in activities on the Services, or by otherwise contacting us.

The personal information that we collect depends on the context of your interactions with us, the choices you make, and the services and features you use. The personal information we collect can include the following:

Personal Information Provided by You. We may collect your first name, maiden name, last name, and nickname; current and former address; phone numbers; e-mail addresses; business e-mail addresses; and other similar data. We may collect financial information (credit card number, purchase history, invoices) and other similar data, where initiated by you.

Payment Data. We may collect data necessary to process your payment for the services you have selected (such as credit card information). However, if any payment information is collected directly from our site, it is for use by a third party payment processing system, and the payment data is stored by that third party payment processor; we do not maintain that information on our site or otherwise. All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

We indicate the specific processing grounds we rely on next to each purpose listed below.

  • Vendors, Consultants, or Other Third-Party Service Providers. We may share your data with third party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, practice management, data analysis, e-mail delivery, hosting services, customer service, and marketing efforts. We may allow selected third parties to use tracking technology on our website, which will enable them to collect data about how you interact with our website. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, and better understand online activity. Unless described in this Policy, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes. 

  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.

If you voluntarily disclose your information in chat areas or bulletin boards maintained by or connected to us (e.g., comments sections, social media posts/groups, message boards, or other similar forums), that information may be seen and used by others, and could result in unsolicited messages from others. We are not responsible for the user information you may choose to submit in these public forums. To request removal of your user information from any of our community forums, please contact us as provided below. In some cases, for legal retention purposes or technical limitations (e.g., the data may not be searchable), we may not be able to remove user information voluntarily disclosed by you in such forums, in which case, we will notify you.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.


7. HOW DO WE KEEP YOUR INFORMATION SAFE?

We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented industry standard appropriate technical and organizational security measures designed to protect against unauthorized access, alteration, disclosure, or destruction of your personal information and data stored on our site. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our website is at your own risk. In addition, you may request to have user information deleted subject to the “HOW LONG DO WE KEEP YOUR INFORMATION?” section above.

  • Withdraw your consent at any time. You have the right to withdraw consent where you have previously given it to the processing of your Personal Information.

  • Object to processing of your data. You may have the right to object to the processing of your data if the processing is carried out on a legal basis other than consent.

  • Access your data. You have the right to learn if data is being processed, obtain disclosure regarding certain aspects of the processing, and obtain a copy of the data undergoing processing.

  • Verify and seek rectification. You have the right to verify the accuracy of their data and ask for it to be updated or corrected, and it is required for you to do so in order to use the site.

  • Restrict the processing of your information. You have the right, under certain circumstances, to restrict the processing of your data. In this case, we will not process your personal information for any purpose other than storing it.

  • Have your Personal Information deleted or otherwise removed. You have the right, under certain circumstances, to obtain the erasure of their Data from the Owner.

  • Receive your data and have it transferred to another controller. You have the right to receive your data in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that the data is processed by automated means and that the processing is based on your consent, on a contract which you are part of, or on pre-contractual obligations thereof.

  • Lodge a complaint. You have the right to bring a claim before the competent data protection authority.

We are located and operating in the United States of America, and our website is not intended for users in the European Economic Area. If you choose to access the site and/or provide your personal information, please note that your information will be transferred to the U.S.A. You accept full responsibility for compliance with the laws of the jurisdiction where the access occurs. We make no representation that the website or our services are appropriate or available for use in locations outside the United States. Accessing the Site and/or using any of the services or materials from any jurisdiction where such access and/or use is illegal is prohibited.

California Civil Code Section 1798.83 permits California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes, and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. 9. DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly collect data from or market to children under 18 years of age.

Our website is not intended for use by minors. We do not knowingly solicit data from or market to children under 18 years of age. By using the website, you represent that you are at least 18, or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the website. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 10. DATA BREACH

A privacy breach occurs when there is unauthorized access to or collection, use, disclosure, or disposal of personal information. In the event that we become aware of a security breach which has resulted or may result in unauthorized access, use or disclosure of personal information, we will promptly investigate the matter and notify the applicable supervisory agency not later than 72 hours after having become aware of it, unless the personal data breach is unlikely to result in a risk to the wellbeing, rights, or freedoms of natural persons.


11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.



12. DO WE MAKE UPDATES TO THIS POLICY?

Yes, we will update this policy as necessary to stay compliant with relevant laws.

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.
